Article 9 | Use of the games

8.1. General

8.2. Game Features

Article 10 | Game

Article 11 | Bonus

Article 12 | Depositing and withdrawing money

Article 13 | Warranty and limitation of liability

Article 14 | Intellectual property

1. b) Casino777.nl believes that the User has violated one or more provisions of these general terms and conditions, unless the violation in question does not reasonably justify this measure;
c) the User has not provided all the evidence necessary to verify his/her User Account within the specified period, or to properly conduct the (enhanced) customer investigation as referred to in Article 5 of these general terms and conditions;
d) the information provided to Casino777.nl is incomplete or incorrect;
e) the conditions for registration of the User are not or no longer met;
f) the User is subject to a gambling ban;
g) the User abuses the procedure for creating a User Account;
h) the User abuses bonuses, promotions and/or any other offer from Casino777.nl;
i) Casino777.nl suspects or discovers fraudulent or illegal activity by the User, or suspects or discovers an attempt to make illegal use of the Website, Software or gambling services, including the use of a User Account by another User, even with that User's consent;

l) The (enhanced) customer investigation as referred to in Article 5 of these general terms and conditions leads to the conclusion that there may be objections to the User on the basis of the rules set out in the Wwft.

3. Suspension and termination of the Agreement will result in suspension or termination of the User Account, respectively.

4. If the User Account is suspended or closed for any of the above reasons, Casino777.nl has the right to retain any amounts on the User Account to compensate for any administrative costs, damages and interest owed by the User, or to comply with the rules of the Wwft and the Sanctions Act. The User will be notified by e-mail of the suspension or closure of his/her User Account.

5. Casino777.nl reserves the right to:

- to notify all competent authorities of any activities of the User that are illegal or suspected of being illegal;
- to block the User's balance to avert the consequences of suspected or proven abuse or unlawful use of the Website or the gambling services;
- to take all legal steps necessary or useful to stop the infringement attributed to the User, obtain reparations for the damages suffered by Casino777.nl or recover winnings.

Article 16 | Termination of the Agreement by the User

1. The User may terminate the Agreement at any time, and consequently terminate his/her User Account, by sending an e-mail message to [email protected]. The Agreement will be terminated once the User has received written notice from Casino777.nl confirming the termination of the Agreement.

2. The User can also apply for a request to stop gambling at the Central Register for Exclusion from Gambling (CRUKS). After registration in CRUKS, he/she will no longer have access to all providers with a license from the Gaming Authority for (i) offering remote gambling, (ii) gaming arcades in the Netherlands and (iii) casinos operated by Holland Casino. Registration in CRUKS can be voluntary or involuntary.

In the case of voluntary registration, a minimum registration period of six months applies, whereby the User has the option to extend this period. 3. CRUKS applications can be submitted in two ways:

- via an online application (effective immediately);
- via a paper form that can be downloaded ( registration takes a few days).

At the end of the User's voluntary registration, the registration will be automatically deleted. The User does not have to do anything and will not receive any notification. In the case of involuntary registration, the registration period will always last at least six months. This can be extended by means of a new request.

4. Voluntary or involuntary registration in CRUKS does not affect the agreement between User and Casino777.nl.

Article 17 | Consequences of suspension and termination of the User Account

1. Termination of the User Account means that the User will cease all use of the Website, the Software and the games. This includes, among other things, that the User loses the ability to withdraw and deposit funds and to participate in the games.

2. Suspension of a User Account entails the immediate blocking of the funds on the User Account. The User also loses the ability to deposit funds or participate in games.

3. Permanent closure of the User Account will result in any credits on the User Account being immediately deposited into the counter account referred to in Article 4. 9 of these General Terms and Conditions, unless Casino777.nl determines or reasonably suspects that the User has committed fraudulent or illegal activities or otherwise acted in violation of these General Terms and Conditions. If a refund of credits is not possible for reasons attributable to the User, for example because the User has changed his/her bank account details without notifying Casino777.nl, management fees for the closed account will be applied at a rate of two percent per month, with a minimum of 3 euros per month. These fees only apply to closed accounts for which it is not possible to transfer the balance for reasons attributable to the User.

4. Any amounts paid by Casino777.nl in the form of a bonus or promotional offer will expire upon termination of the User Account.

5. Casino777.nl will confirm the termination of the User account to the User by e-mail.

Article 18 | Responsible Gambling

1. Casino777.nl advises the User to gamble in moderation.

2. The User is informed that in some people an increase in the duration or frequency of gambling may develop into a state of dependence or lead to a certain mental vulnerability.

3. The User must know that addiction is characterized by an inappropriate, persistent and repeated urge to gamble. The pleasure of gambling then changes into an urgent need to gamble with potentially serious consequences for the User and those around him/her.

The User can access the "Responsible gaming" page at any time.This page informs the User of all available tools and guidelines regarding the use of such tools and mechanisms implemented on the website. These include, but are not limited to, deposit, time and balance limits; self-exclusions; game exclusions; session limits, and the exclusion planner. This page also contains information about addiction care (organizations) and anonymous help that can be consulted if the User deems it necessary. Casino777.nl urges each User to be aware of his/her own responsibility, so that he/she can always play responsibly and in moderation.

5. Casino 777.nl reserves the right to make additional tools available and to update or remove current tools

6. The User may apply a self-exclusion from the Website for a minimum of one (1) day up to a maximum of six (6) months. The self-exclusion will be effective immediately and the User will be subject to restrictions. The User may also contact the helpdesk to close his/her account indefinitely or permanently. It may take up to 24 hours for the self-exclusion to be processed on our server. The User acknowledges and agrees that he/she may be subject to marketing communications for up to 24 hours after applying a self-exclusion, but that he/she will no longer be able to respond to communications or promotions. The User will not be subject to further marketing communications after the 24-hour period.

The User is not guaranteed any compensation in the event that the User has taken advantage of promotions or gambled during the 24-hour period in which the self-exclusion is processed on our server.

7. The User can voluntarily register with CRUKS. A registration in CRUKS ensures that the User no longer has access to all legal gambling websites, slot machine halls and casinos in the Netherlands. Casino777.nl can only detect the registration of a User in CRUKS in the following situations:

a. The person was registered in CRUKS while trying to register on the Casino777.nl website, and Casino777.nl received a “hit” from CRUKS stating that the person in question is registered with CRUKS.
b. The User attempted to log in and Casino777.nl received a confirmation from CRUKS stating that the User in question is registered with Cruks.
c. The User contacted [email protected] to inform Casino777.nl that he/she is registered with CRUKS.

8. In view of paragraph 7 of this article, Users acknowledge and agree that they may be subject to marketing communications when they are registered in CRUKS and Casino777.nl is unable to detect whether such User is registered in CRUKS. In order to enable Casino777.nl to comply with its legal obligations, Users hereby expressly represent and warrant that they will immediately notify Casino777.nl when they register themselves or become aware that they have been involuntarily registered in CRUKS. Users may send such notification to [email protected] and include at least the following information:

a. Username;
b. First and last name;
c. Date of birth;
d. Place of birth;
e. Start and end date of the CRUKS registration

9. The User is responsible for informing [email protected] if the User has decided to extend his/her CRUKS registration beyond the initially communicated end date, and in the event of other relevant changes regarding the CRUKS registration.

10. Casino777.nl reserves the right, in the event that the User (i) fails to immediately notify Casino777.nl of his CRUKS registration or (ii) attempts to circumvent the technical measures to use Casino777.nl services while registered in CRUKS, to withhold withdrawals or the balance on their player account and/or initiate legal proceedings to recover any funds, as well as any costs that Casino777.nl may incur as a result thereof.

Article 19 | Complaints

1. Complaints of any nature must be reported to us as soon as possible by contacting our customer service and no later than six (6) months after the problem occurred.

2. If you are not satisfied with the initial resolution or support from our customer service team, you can request to escalate the issue internally. In this case, the complaint should be sent to [email protected] . Casino777.nl will not process complaints submitted via other means, such as social media.

3. Any complaint filed must include the following information:

a. Username
b. First name, last name and date of birth
c. The contact details you would like to be contacted on (if applicable)
d. A description of your complaint, including at least a description of:

i. the date the problem occurred;
ii. the reason for dissatisfaction;
iii. the desired resolution (if applicable).

e. Any evidence to support your complaint (if applicable).

4. Failure to submit the required information and documentation as described above may result in a delay in our ability to identify and respond to your complaint in a timely manner, or may result in your complaint being dismissed.

5. Receipt of an email will be confirmed within 72 hours.

6. Complaints will be handled as soon as possible but in any case within a period of eight (8) weeks. The User will be informed in an appropriate manner, including reasons, about the findings regarding their complaint and the associated conclusions.

7. Any complaints about the resolution or support of the customer service team must be submitted no later than 30 days after the event. If the complaint is submitted later than 30 days after the event in question, the complaint will be declared inadmissible.

8. If a User files a complaint, Casino777.nl reserves the right, without prior notice and without prejudice to any subsequent proceedings, to close the User's account, to refuse access to all or part of the Services, and in particular to reject a bet or transaction, or to withdraw offers from Casino777.nl pending the conclusion of any proceedings. Should this occur, Users have the option to withdraw any outstanding funds that may be in the Player Account, subject to the procedures set out in these Terms and Conditions and applicable law, in which we are obliged to retain the available funds.

9. Article 20 | Transferability of the Agreement

1. The rights and obligations of the User under the Agreement cannot be transferred to a third party.

2. Casino777.nl is entitled to sell the Software, the Website and part or all of the games of chance without prior permission from the User.

Article 21 | Security measures

Casino777.nl implements security measures to protect the User's personal data from unauthorized access and use. Nevertheless, the User acknowledges and accepts the fact that transmissions via the Internet are never completely confidential and secure. The User acknowledges that messages and information that the User sends via the Website may be read or intercepted by other people, even if a special notice indicates that a particular transmission is encrypted.

Article 22 | Availability of the services

1. Connection to the Website and use of the services offered implies that the User is aware of and accepts the characteristics and limitations of the Internet, in particular with regard to technical performance, response times for viewing, retrieving or transferring information, the risks of interruption and, more generally, the risks inherent in connection and transmission via the Internet or via mobile telephone networks, the lack of protection of certain data against misappropriation and the risks of contamination by computer viruses circulating on the Internet and mobile telephone networks.

Article 24 | Rights in case of non-strict compliance with these general terms and conditions

If Casino777.nl does not demand strict compliance with these terms and conditions at all times, this does not mean that these terms and conditions do not apply or that Casino777.nl loses the right to demand strict compliance with these terms and conditions in future cases.

Article 25 | Invalidity

The annulment or nullity of one or more of the provisions of these general terms and conditions or the Agreement as such shall not affect the validity of the other provisions. In such a case, the Parties are obliged to enter into mutual consultation in order to make a replacement arrangement with regard to the affected provision. In doing so, the purpose and scope of the original provision shall be taken into account as much as possible.

Article 26 | Archiving and evidence

1. The files, data and documents kept by Casino777.nl are considered full proof of communications and the results of the games of chance.

2. Casino777.nl stores all written documents of each Agreement for the purpose of using the services of Casino777.nl, in electronic form and without disclosing these documents to third parties.

3. In the event of any discrepancies between the result of a game displayed on the Website and the result registered directly or indirectly by Casino777.nl, in particular on its computer server via the Software, the result registered by Casino777.nl shall prevail at all times.

Article 28 | Applicable law and disputes

1. The Agreement is governed by Dutch law, without prejudice to the mandatory provisions that the User could enforce pursuant to Article 6 of Regulation (EC) No 593/2008 of the European Parliament and of the Council on the law applicable to contractual obligations (Rome I).

2. In the event of a dispute between the Parties arising from or related to the use of the Website by the User, the Parties will attempt to resolve this dispute by mutual agreement within 14 days of the dispute arising. If it proves impossible to resolve the dispute within the set period, the Dutch court will have jurisdiction to hear the dispute.

3. The limitation period for all claims and defenses against Casino777.nl is shortened to one year.

NB: In the event of any discrepancies between the Dutch and English versions, or versions in a language other than Dutch or English, of these general terms and conditions, the Dutch version shall prevail.

TERM

This latest version of these terms and conditions is valid indefinitely until the User cancels their registration on the Website. The User can use the services as soon as their registration has been confirmed by Casino777.nl.
